Peaceably to Assemble, and to Petition the Government, 6 Jan, D.C.

Image from twitter cropped and scaled by Dean Weingarten

President Trump has called the people to peaceably assemble in Washington, D.C. on 6 January, 2020. The People will petition the Government to redress grievances, particularly the fraudulent election of 2020.

Half the country believes the election was stolen from President Trump. Half of the rest are uninformed or misinformed. The evidence is accumulating, day after day. It is creeping through the censorship of big media and the tech oligarchs. More and more people are becoming informed. More and more people are becoming angry.

The report by Peter Navarro lays out the election fraud in the six swing states for all to see.

The peaceable assembly in DC is a way to redress  the people's grievances.

There are many grievances.

Those who have seen their jobs shipped overseas to China, as the Chinese Communist Party steals the Western world blind, with the assistance of our ruling class/media/and tech giants, are likely to show up.

The veterans, who risked life and limb, and saw buddies die as they fought to preserve the Constitution, and now see it being shredded, are likely to show up.

Those whose businesses have been destroyed, fortunes lost, dreams imploded by state governors determined to destroy the economy to get rid of President Trump, are likely to show up.

Those who lost loved ones to lawless illegal immigrants, who flout our laws and disrespect our culture, egged on by politicians who wish to replace their current constituents, are likely to show up.

Those who see their children indoctrinated in government run schools to disrespect their parents, hate themselves and their country, are likely to show up.

Those who are tired of being told people can change their sex as they change their clothes, who see children deliberately being sexualized under the age of eight, and who are threatened if they oppose such indoctrination, are likely to show up.

Those who have been told, they have to hate themselves because of the color of their skin, that discrimination is the only reason for inequality of result, and, if they will not repeat the lie themselves, they will no longer have a job, are likely to show up.

Those who see a corrupt ruling class who claim citizenship of the world rather than allegiance to the United State; a ruling class which sees military power of the USA as a problem, rather than prudence in a dangerous world; a ruling class which sees American patriots as deplorables, instead of creators of solutions; those who see the reality of the rulers, are likely to show up.

Those who see the United States as the greatest nation which has ever existed on the face of the earth, a nation which has achieved the greatest prosperity, the greatest freedom, the greatest technology, the greatest military strength, the wealthiest and fattest poor people on the planet, are likely to show up, to oppose those who want to destroy the United States as it exists.

All who want to show up will not be able to. The hour is late. There are only a few days to make it to DC by the morning of January 6th.

Americans are problem solvers. We instinctively form committees, organize church groups, and learn to rely on each other when defense of the nation requires it. The commercial planes to DC are filling fast. Buses are being organized. Caravans are being created from as far as California.

If you do not have the means to go, several friends can pool resources to send a representative.  People who cannot spare the time can sponsor those who have time to spare.

People can support those who are able and willing to go in many ways. The people will need shelter and support on the way. There will need to be parking and shuttles organized closer to D.C.

With President Trump as the Commander in Chief, patriots need not worry about being machine gunned in the streets, as a dictator might in a nation without the Constitutional guarantee of peaceable assembly to petition the government.

The United States is not Venezuela... yet.

What ever happens on 6 January, 2020, will be history making, and significant for the future of the United States.

Years, decades, in the future, people will be asking: Where were you on that fateful day?

PA: Attempted Murder at Gun Range Stopped by Armed Samaritan

Image  screenshot from video  cropped and scaled by Dean Weingarten

On 22 December, 2020, at about 2:08 p.m. at the State Game Lands Shooting Range 109, in Erie County, Pennsylvania, a highly unusual attack and defensive shooting occurred.

The shooting range is located in a dense wooded area. There are nine shooting points; three for pistols with a 25 yard range, and six for rifles, with a 100 yard range.  Tuesday was dull and dreary with a westerly wind of 14 mph. Before noon it had been overcast with a light rain. By two p.m, the sun was occasionally peeking through the clouds.  It was cool and cloudy at 39 degrees F.

Satellite view of Erie County Game Lands Shooting Range 109 from Google maps, cropped and scaled by Dean Weingarten

Two young couples had arrived in separate vehicles. One of the two young men had recently purchased a pistol. The two young men and two young women reportedly took turns shooting the pistol, at the range.

Then, from reported accounts, Robert A. Epply, 26 fired five shots down range, turned around, and started firing at his 28 year old male friend.  An Internet search reveals little of Robert Epply, except, in 2012, he briefly listed a post office box on Parris Island, North Carolina, a Marine Corps installation.

There was an Armed Samaritan on one of the other two pistol firing points. He observed what was happening, and quickly acted. He shot Robert Epply to prevent further attacks and to stop the shooting of the 28-year-old.

Three people were at the rifle portion of the range. They heard the shooting, but did not see the events as they happened.

Epply was declared dead at the range at 3:11 p.m. From goerie.com:

Eppley was pronounced dead at the scene of the shooting, at the State Game Lands 109 gun range at 10679 Sampson Road, at 3:11 p.m. Tuesday by Erie County Deputy Coroner John Maloney.

A 4½-hour autopsy performed Wednesday by Erie County forensic pathologist Eric Vey, M.D., determined that Eppley died of gunshot wounds to the torso, Erie County Coroner Lyell Cook said.

The 67-year-old man who was nearby, who Weindorf said had no connection to the two men, saw what was happening and fired on Eppley, who was still shooting at his friend, Weindorf said.

Murders at shooting ranges are very rare events. Prominent Marine sniper Chris Kyle and friend Chad Littlefield were murdered at a Texas shooting range, in 2013, by a mentally disturbed drug user, Eddie Ray Routh, who Kyle was attempting to help. Routh was sentenced to life in prison.

In Pennsylvania, the shooter was stopped before he was able to kill his first victim.  The identity of the armed Samaritan and the victim have not been released to the public.

The deceased attacker has been identified as Robert A. Epply.

Internet records show a person with the same name, associated with an September, 2012 address in North East PA, listed a post office box at the Parris Island Marine Recruit Depot in July of 2012.

It is likely the same Robert A. Epply, but what connection he may have had with the Marine Corps is indeterminate at this time.

Previous Marine recruits have told me all mail was sent through their training unit. Training units have post office boxes. Searches have not associated the P. O. box associated with Robert Epply with a particular training unit.

Police are continuing to investigate the Pennsylvania shooting. The victim was released from the hospital on the 23rd of December, according to US News. No motive for the attack has been determined.  The 67-Year-Old armed Samaritan has been released. No charges are pending at this time.

Update: His obituary shows he served as a Marine. His fiancee  knew the friend who Robert was shooting at and wounded.  His fiancee has been reported as being pregnant with Robert's unborn daughter.

Might this have been a domestic situation?

President Trump Calls for Massive Protest, DC, 6 January, 2020

Image from twitter cropped and scaled by Dean Weingarten

President Trump has called for patriots to come to D.C. on 6 January, 2020.

I will be there, covering the event for AmmoLand.

Patriots in the United States face a major Constitutional crises, as the 2020 elections are severely tainted.  Candidate Biden talks about requiring registration and additional taxes on the most popular rifles in the United States. The establishment wants to return to the insider pork barrel days before President Trump, when turning a 1.5 billion dollar deal with the Chinese was not worth looking at by the establishment Media.

The report by Peter Navarro lays out the election fraud in the six swing states for all to see. It is a masterful compilation of the way rules were broken or ignored, laws illegally changed, safeguards circumvented, voting machine irregularities, outright fraud with ineligible ballots, and significant statistical irregularities.

The powerful in the United States have not believed in the consent of the governed for a long time. From about 1900, a growing majority of those in positions of power have been infected by the disastrous philosophy of Progressivism/Leftism. They do not believe in the validity of the Constitution. They do not believe in Christian morality. They only believe in power, and their right to remake society as they believe it should be.

They believe they should do very well as part of all this restructuring. Few in Congress leave without becoming rich. It is cheap for the Chinese government to buy influence. Far cheaper than conquering by military force.

An article in The Nation shows the left is not interested in fairness or equality before the law. The want black votes to count twice, as "reparations".  They do not consider the United States government or founding to be legitimate. This is why they hate America, and want to tear it down, in spite if the inarguable success of American society, culture, technology, military power, and freedom.

Racism exists. It will always exist. It is not the dominant force in American society. A black person in America has more freedom than a black person anywhere else in the world.  Black people from Africa and the Caribbean prosper in the United States in ways they could never dream to prosper in Africa or the Islands.  That proves skin color is not the primary problem.

This does not matter to leftist racists and bigots. They hate America, and want it to fail.  They insist discrimination by color of your skin, or sex, or country of origin is fine, as long as they get to decide who gets discriminated against. Today's Left/Progressives no longer hold allegiance to the United States. They are globalists or anarchists.

They want the American public disarmed. People do not want to disarm you because they are going to do something nice.

We have come to a place in the United States where the dominant Media has become the enemy of the people; where clear evidence of corruption with foreign governments is censored before an election to tilt the playing field toward the favored candidate of the Media.

Half of the country no longer believes the Media. Half the country believes the election was stolen.

Hotels and commercial transport to DC for the 6th are filling up rapidly. Patriots will need to step up to the plate with accommodations, transport, and organizations to aid those from outside the area.

Second Amendment supporters should play a role in the organization and support for the protest.

TIme is short.

See you in the District of Columbia on 6 January, 2020.

NJ AG Gurbir Grewal: More Persecution against S&W, First and Second Amendment

New Jersey's tyrannical Attorney General, Gurbir Grewal, is adding to his dubious list of anti-Second Amendment activism.  On 15 December, 2020, Smith & Wesson sued Grewal, asking for relief, for using his office to violate the First Amendment, Second Amendment, as well as the Fourth, Fifth, and Fourteenth amendment protections of the U.S. Constitution.

Defense Distributed won a significant victory  in September of 2020, with the Fifth Circuit agreeing Defense Distributed could sue AG Grewal in Texas. The case is ongoing, and alleges Grewal violated Defense Distributed's First Amendment rights.

The Smith & Wesson lawsuit is about a subpoena issued on October 13, 2020, by Grewal, alleging fraud on the part of Smith & Wesson, for advertising with claims such as Smith & Wesson products are safe, or they enhance a person's lifestyle.  From the lawsuit:

1. The First Amendment to the U.S. Constitution guarantees the right to free speech "no matter whether the government disagrees with that speech. Benjamin Franklin articulated it this way: “Freedom of speech is a principal pillar of a free government . . . . When this support is taken away, the constitution of a free society is dissolved.”history have abused their power by punishing speech to suppress dissent and harm political opponents.

2. Following in the abusive footsteps of these repressive regimes, the New Jersey Attorney General has taken a series of actions to suppress Smith & Wesson’s speech, and with the intention of damaging Smith & Wesson both financially and reputationally. The most recent such action is the issuance of an administrative subpoena (the “Subpoena”) on October 13, 2020 that allegedly seeks evidence of consumer fraud relating to advertising – but in reality, it seeks to suppress and punish lawful speech regarding gun ownership in order to advance an anti-Second Amendment agenda that the Attorney General publicly committed to pursue.

3. The Subpoena presents no legitimate inquiry into any purported fraud, and instead targets mere opinions and other protected statements allegedly made by Smith & Wesson, such as (1) whether Smith & Wesson’s products are “safe,” make a home safer, or enhance one’s lifestyle; (2) whether an untrained consumer could successfully and effectively use a Smith & Wesson firearm for personal or home defense; and (3) whether private citizens should have the right to carry a concealed firearm. The only fraud here is the Attorney General’s abuse of his position to suppress a political viewpoint with which he disagrees.

Grewal is expanding one of the lines of attack against the Second Amendment pioneered in Connecticut, where private parties sued Bushmaster in an attempt to avoid the protections given by the United States Protection of Lawful Commerce in Arms Act (PLCAA).

The lawsuit was allowed to proceed, because it claimed Bushmaster violated a broad and vague provision of Connecticutt consumer law.  They claimed the lawsuit was valid, under the theory Remington had illegally marketed the rifle by "glorifying its use to civilians." That appears to be a direct violation of Remington's First Amendment rights.

Gurbir Grewal is a Sikh, not a Muslim or Hindu.  He was born in New Jersey of Indian immigrant parents. Grewal seems to be ignorant about guns. He grew up in an extremely restrictive firearms environment.  New Jersey is one of six states which does not have a protection for the right to keep and bear arms in its constitution. The other five without such a provision are California, Iowa, Maryland, Minnesota, and New York.

Grewal's foundational philosophy appears to be a form of progressivism.

Progressivism detests the concept of the Second Amendment in its bones.

With the unwillingness of the Court to take on Second Amendment cases for 10 years, many Second Amendment supporters were hopeful the appointment of three originalists by the Trump administration would break the logjam.

Now, the same supporters are wondering if the Court will uphold the First Amendment, or nullify the First Amendment when it comes to Firearms.

Clark County Nevada said to have 70% "adjudication" rate, Same as Antrim County Fraud Machine

Second Amendment rights, indeed all rights in the Bill of Rights, appear to be up for grabs in this election. The election results are hotly contested, especially the accuracy and dependability of Dominion voting systems.

A number of reports are circulating around the internet, suggesting that Nevada Dominion vote counting machines have produced similar results to those seen in an Antrim County Michigan forensic audit.

A recap of the Antrim County, Michigan, forensic audit:

Only one county's Dominion voting machines appear to have been subjected to a forensic audit. The machines in Antrim County, Michigan were audited as part of an inquiry ordered by a Michigan judge, Kevin A. Elsenheimer.

Michigan's Secretary of State, Jocelyn Benson, and Attorney General, Dana Nessel sought to block release of the results of the audit. Benson and Nessel are hard left Democrats.

Judge Kevin A. Elsenheimer later decided to release the results, which were explosive.

The forensic audit of the Antrim County, Michigan, voting machines produced startling claims. Here is a link to the pdf report  by Allied Security Operations Group. I have scanned and formated findings 6,7, and 8 below:

6. The allowable election error rate established by the Federal Election Commission guidelines is of 1 in 250,000 ballots (.0008%). We observed an error rate of 68.05%. This demonstrated a significant and fatal error in security and election integrity.

7. The results of the Antrim County 2020 election are not certifiable. This is a result of machine and/or software error, not human error.

8. The tabulation log for the forensic examination of the server for Antrim County from December 6, 2020 consists of 15,676 individual events, of which 10,667 or 68.05% of the events were recorded errors. These errors resulted in overall tabulation errors or ballots being sent to adjudication. This high error rates proves the Dominion Voting System is flawed and does not meet state or federal election laws.

Finding number 11 is extremely important to understand. If it is correct, forensic audits of the Nevada machines are essential.

11. It is critical to understand that the Dominion system classifies ballots into two categories, 1) normal ballots and 2) adjudicated ballots. Ballots sent to adjudication can be altered by administrators, and adjudication files can be moved between different Results Tally and Reporting (RTR) terminals with no audit trail of which administrator actually adjudicates (i.e. votes) the ballot batch. This demonstrated a significant and fatal error in security and election integrity because it provides no meaningful observation of the adjudication processor audit trail of which administrator actually adjudicated the ballots

Consider the similarities between the Antrim County, Michigan results and those in Clark County, Nevada, as exposed by a Las Vegas Review Journal article.

On November 6, 2020, Thonda Prast, in the Las Vegas Review Journal, wrote an article on "How are Nevada ballots counted and verified?"

Prast wrote an explanation of how mail in ballots were counted in Clark County. This paragraph is remarkable, given the information from Antrim County in Michigan. From reviewjournal.com:

All mail ballots in Clark County were counted first by running them through a digital scanner. If the scanner cannot read the ballot or determine the voter’s intent, the ballot is sent to an adjudication or duplication team, both of which are overseen by a bipartisan election board. County elections officials have said about 70 percent of ballots are sent to be reviewed by elections officials.

If 70% of ballots go to adjudication, what is the point of running them through the scanner?

That would be 35% of all ballots in Clark County! The Antrim County, Michigan forensic audit report says there is no audit trail of ballots sent to adjudication.

The Clark County statement says the adjudication or duplication team is "overseen" by a bipartisan election board.

What does that mean?

We are talking about 210,000 ballots in Clark County which would go through this process. Was each one looked at individually, by bi-partisan observers of the "board"?

How else would ballots, which have already been judged by the scanning machine, as beyond the ability of the scanner to read, be interpreted?

A 70% rejection of ballots by scanner seems absurdly high.

There may be a simple explanation. Clark County officials should show us, precisely, with logs and clear accountability, how these 210,000 ballots were counted and accounted for.

The integrity of the 2020 elections, especially in "swing" states, is in doubt.

21 Democrats Demand They, and all Members of Congress be Disarmed

New Member of Congress, Second Amendment supporter, and Open Carrier, Lauren Boebert, refuses to back down from the Deep State in Washington D.C. She is going to exercise her Second Amendment rights in D.C. and the Capitol.  Now, as a member of the favored few, in Congress, she has rights and privileges most of us do not. She is using her status to fight for the rest of the country, and the Constitution.

Because she is willingly to openly exercise her Second Amendment rights, with strong, protected, symbolic speech, Democrat members of the House are working to eliminate those rights. From foxnews.com:

"The Democrats are always up for stripping away our Constitutional rights and feel threatened when we simply want to exercise those rights," Boebert told Fox News Wednesday. "I carry a firearm to protect myself and want to exercise my right to do so in one of the most dangerous cities in America. They want to take that right away from me. I look forward to helping make sure they can't."

Those members of Congress were perfectly willing to allow members of Congress to have the right to keep and bear arms, as long as it was on the "low down", in the closet, lest the public get the idea the Second Amendment actually meant something. But now that photogenic and principled Representative Boebert refuses to stay in the Second Amendment closet, that is not allowed.

The Orwellian statement of Representative Huffman is a good place to start. From Representative Jared Huffman, (D) California:

Threats of political violence are on the rise, and it makes all of us less safe if Members of Congress don’t have to comply with gun safety standards. I led my colleagues in a call to modernize the House’s outdated & dangerous rules for everyone’s safety.

Notice Huffman, in his statement, calls for generic and mild sounding "gun safety standards".  The statement is about the letter he promoted, and signed with 20 other Democrat House Members. The particulars are clear. The letter calls for a complete ban of guns.

There is no error: Huffman equates "gun safety standards" with a complete gun ban. From the letter to Nancy Pelosi, Speaker of the House, and Kevin McCarthy, Minority Leader, bold added:

Ultimately, the current regulations create needless risk for Members of Congress, their staff, members of the Capitol Police, and visitors to the Capitol grounds. A provision in the Rules package directing the Capitol Police Board to ensure that Member of Congress may not possess firearms on Capitol grounds would ensure clarity surrounding firearms policy and protect all individuals in and around the Capitol. We urge inclusion of this commonsense protection in the 117th Congress.

This is the simplistic, emotional, and fact free phobia of gun hatred. A former essay on this subject is linked here.  It is, simply, Guns are Bad. It is an irrational fear. It is a mental condition.  It is dangerous, to allow people with this sort of mental illness to be in a position of power in Congress.

It makes you wonder why these Democrats do not call for taking away the guns from the Capitol Police.

Democrats who openly state that a total ban on guns is a "gun safety measure" are listed below. Their district information is available with an easy couple of clicks at congress.gov. The link for Nanette Barragan is given as an example, to show what is available.

Nanette Barragan, District 44, California (Los Angeles)

Donald S. Beyer, Jr., District 8, Virginia (Alexandria, half inside the beltway at D.C.)

Salud Carbajal, District 24, California (Los Angeles along coast to North)

Andre Carson, District 7 Indiana (Indianapolis)

Sean Casten, District 6, Illinois (West Chicago suburbs)

David Cicilline, District 1, Rhode Island

Veronica Escobar, District 16, Texas (El Paso)

Raul Grijalva, Arizona, District 3, (highly gerrymandered, Tucson, Phoenix, Yuma)

Jahana Hayes, Connecticut, District 5

Jared Huffman, California, District 2, (San Francisco)

Pramila Jayapal, Washington State, District 7, (Seattle)

Daniel T. Kildee, Michigan, District 5

Robin Kelly, District 2, Illinois (Chicago)

Grace Meng, District 6, New York, (New York)

Eleanor Norton, District of Columbia, non-voting

David Price, District 4, North Carolina, (Durham)

Mike Quigley, District 5, Illinois, (Chicago)

Jan Schakowsky, Distrct 9, Illinois, (Chicago metroplex)

Mark Takano, District 41, California, (Riverside)

It is painful for this correspondent to notice Raul Grijalva from Arizona is one of those listed. Raul is a disgrace to the state. He is in a safe district. Perhaps some Arizona citizens will read this and realize their rights will always be in danger while he is in public office. Fortunately, he does not seem to be very energetic.

Supreme Court Refuses to Hear Texas v. Pennsylvania, Claims Lack of Standing

On 11 December, 2020, the Supreme Court of the United States refused to hear the case Texas v. Pennsylvania. The court cited "lack of standing" as the reason. The vote has been reported to be 7-2 with Justice Thomas and Justice Alito dissenting. From the Supreme Court Website:

The State of Texas’s motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution. Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot. Statement of Justice Alito, with whom Justice Thomas joins: In my view, we do not have discretion to deny the filing of a bill of complaint in a case that falls within our original jurisdiction. See Arizona v. California, 589 U. S. ___ (Feb. 24, 2020) (Thomas, J., dissenting). I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.

It is a devastating decision for President Trump and the Republic.  There are other routes through the Supreme Court to reverse the tainted elections in swing states, but this decision shows how reluctant the Court is to hear an election case.

There are other remedies. The electoral college was designed to prevent exactly such a situation, where a recognizable corrupt individual was somehow elected by the popular vote.

The Constitution has been so battered by the assault of the Progressives over the last century, few checks and balances have much strength any more.

Barring unforeseen miracles or accidents, such as Joe Biden tripping over a dog and cracking his skull instead of his foot, a Biden/Harris or Harris/Biden presidency grows closer.

With the election behind us, the Left/Media/Tech Oligarchs/Deep state are covering the Biden corruption story like it just appeared, out of nowhere.

If they had covered the story when it was orginally released, it is almost certain Joe Biden would never have been elected. President Trump's victory would have been exceedingly hard to overcome, even with massive cheating.

The fallout of the Supreme Court not having the courage to do their duty will be large. It is bound to depress voters, at least for a few days, in the critical senatorial runoff elections in Georgia.

A never give up attitude is needed, now more than ever.  They Senate stands as a significant barrier to the United States going all out Venezuela.

Today, the Sean Hannity radio show version on Facebook was throttled bad to 19 views from 200,000 for putting out "misleading" information about the election and vote fraud, according to the radio show.

There are still many battles to be fought. This is a setback, but the mask is off. We lost a battle, not the war.

Most of the Left's power is in its ability to control the information flow.

One of the best things a patriot can do, is support platforms which do not censor their political content.  Second "Amendment supporters need to continue doing what we have been doing for the last 50 years. Building networks, educating friends and relatives, and continuing to fight.

Maybe the "originalists" on the court will feel compelled to protect the Second Amendment. There are other cases in the pipeline.

Buck up freedom lovers. Protecting freedom can be hard. It is far preferable to the alternatives.

Pray for our country and for a restoration of justice and truth.

Followup MN: No Charges for Pawn Shot Owner who Shot Looter durning Minneapolis Riots

Nobody will be charged in connection to a man's death in May because looters destroyed all security video and only one witness cooperated.

The Hennepin County Attorney's Office said Monday that a pawn shop owner won't be charged in Calvin Horton Jr.'s death after a six-month investigation by Minneapolis police, citing insufficient evidence to overcome a self-defense argument.

Officers were called to 1538 E. Lake Street around dusk on May 27 and found Horton lying on the sidewalk, suffering from a gunshot wound. He later died at a hospital.

St. Louis Circuit Attorney (Prosecutor) Kim Gardner Ordered Removed from McCloskey Case

Image screenshot of public announcement by Kim Gardner, Circuit Attorney

On 10 December, 2020, in the Missouri Circuit Court, the Twenty-Second Judicial Circuit (City of St. Louis), Judge Thomas Clark, II, removed Circuit Attorney Kim Gardner from the prosecution of the criminal case against Mark McClouskey.  The case before the court did not include Mark's wife, Patricia.

The case caught the national attention with the video evidence available.

According to a St. Louis Today.com article, a motion will be filed to extend the ruling to Patricia:

Defense lawyer Joel Schwartz said he’ll file a motion requesting that Stelzer adopt Clark’s ruling in Patricia McCloskey’s case.

“This is what we wanted,” Schwartz said. “We would like a fair-minded prosecutor to take a look at the alleged crimes and reassess the evidence and see what they come up with because we don’t believe any of the evidence supports any of the charges. … As long as that happens, then I think we’ll have the right outcome and that would hopefully be no charges.”

The Court cited both statutory law and rules of conduct for prosecutors. From the Court order,  Rule 4-3.8(f) states:

Although the announcement of an indictment, for example, will necessarily have severe consequences for the accused, a prosecutor can and should avoid comments that have no legitimate law enforcement purpose and have a substantial likelihood for increasing public approbrium of the accused.
Understandably, Ms. Gardner has every right to rebut criticism, but it appears unnecessary to stigmatize Defendant - or even mention him - in campaign solicitations, especially when she purports to be responding to others. In fact, the case law and the Rules of Professional Conduct prohibit it. These expectations are real. For these collective reasons the court grants Defedant's motion and orders that the Circuit Attorney shall be disqualified from prosecuting this matter.
Then the Court disqualifies the entire Circuit Attorney's office from prosecuting the matter as well, saying they are all tainted because they all work for the Circuit Attorney, Kim Gardner. The case has been so public they cannot escape an appearance of impropriety.

In the conclusion, the Court shows they have balanced the will of the voters with the rule of law. From the Court Order:

The court does not seek to disregard the will of the voters and does not make this decision lightly. Ms. Gardner enjoys the honor of representing the citizens as their elected official but she is equally bound by the applicable court precedent and the Revised Statutes of the State of Missouri. She assumed these obligations when she was elected as a public official as well as when she first entered the legal profession. She is accountable - not just to the voters but to the rule of law. The court is similarly obligated to follow the law.

The statute is explicitly clear and without any ambiguity, allowing the court to remove the prosecutor if the prosecutor has a personal interest in a particular case. §56.110 RSMo. The campaign emails demonstrate the Circuit Attorney's personal interest in this case, raise the appearance of impropriety and jeopardize the Defendant's right to a fair trial. Among other previously described concerns, these email solicitations aim to raise money using the Defendant and the circumstances surrounding the case to rally Ms. Gardner's political base and fuel contributions.

The entire ruling is beautifully written. It is a fun read.

The concept that prosecutors can be thrown off a case because of a personal conflict is an important part of the rule of law.  It happens very seldom, but it does happen. It is a refreshing difference from prosecutors being given absolute immunity from lawsuit by the Supreme Court in the 1980's.

The fundraising email sent out by Kim Gardner before she brought charges against the McClouskeys is reminiscent of communist propaganda.

For example, a fundraising email  claims:

"President Trump and the Governor are fighting for the two who pointed guns at peaceful citizens during the Black Lives Matter protests."
"isn't afraid to stand up and hold those accountable who are perpetuating a system of systemic racism and police brutality."

In a later email:

"This is what happens when leaders like Kim stand up against a system that elevates the privileged and powerful."
It is likely voters in St. Louis will continue to re-elect Kim. She is adept at playing the victim card and the race card. She will likely continue to get money from George Soros and similar left wing funds. It seems probable, with a different prosecutor, the charges will be dropped. They never were rational under Missouri law.

Allied Security Operations Group Antrim Michigan Forensics Report, Parts A & B (Election Machine Fraud)

This is a PDF scan of the Allied Security Operations Group, Antrim Michigan Forensics Report, Parts A & B.  The full report is in PDF format at this link.

The table in B 3. is a bit rough.

REVISED PRELIMINARY SUMMARY, v2

Report Date 12/13/2020

 Client: Bill Bailey

 Attorney: Matthew DePerno

 A.WHO WE ARE

1. My name is Russell James Ramsland, Jr., and I am a resident of Dallas County, Texas. I hold an MBA from Harvard University, and a political science degree from Duke University. I have worked with the National Aeronautics and Space Administration (NASA) and the Massachusetts Institute of Technology (MIT), among other organizations, and have run businesses all over the world, many of which are highly technical in nature. I have served on technical government panels.

2. I am part of the management team of Allied Security Operations Group, LLC, (ASOG). ASOG is a group of globally engaged professionals who come from various disciplines to include Department of Defense, Secret Service, Department of Homeland Security, and the Central Intelligence Agency. It provides a range of security services, but has a particular emphasis on cybersecurity, open source investigation and penetration testing of networks. We employ a wide variety of cyber and cyber forensic analysts. We have patents pending in a variety of applications from novel network security applications to SCADA (Supervisory Control and Data Acquisition) protection and safe browsing solutions for the dark and deep web. For this report, I have relied on these experts and resources.

B. PURPOSE AND PRELIMINARY CONCLUSIONS

1. The purpose of this forensic audit is to test the integrity of Dominion Voting System in how it performed in Antrim County, Michigan for the 2020 election.

2. We conclude that the Dominion Voting System is intentionally and purposefully designed with inherent errors to create systemic fraud and influence election results. The system intentionally generates an enormously high number of ballot errors. The electronic ballots are then transferred for adjudication. The intentional errors lead to bulk adjudication of ballots with no oversight, no transparency, and no audit trail. This leads to voter or election fraud. Based on our study, we conclude that The Dominion Voting System should not be used in Michigan. We further conclude that the results of Antrim County should not have been certified.

3.The following is a breakdown of the votes tabulated for the 2020 election in Antrim County, showing different dates for the tabulation of the same votes.

Date Registered Voters Total Votes Cast Biden Trump Third Party Write-In TOTAL VOTES for President

Nov 3    22,082      16,047      7,769      4,509     145      14      12,423

Nov 5    22,082      18,059      7,289      9,783     255      20      17,327

Nov 21  22,082      16,044      5,960      9,748     241      23      15,949

4. The Antrim County Clerk and Secretary of State Jocelyn Benson have stated that the election night error (detailed above by the vote "flip" from Trump to Biden, was the result of human error caused by the failure to update the Mancelona Township tabulator prior to election night for a down ballot race. We disagree and conclude that the vote flip occurred because of machine error built into the voting software designed to create error.

5. Secretary of State Jocelyn Benson's statement on November 6, 2020 that "[t]the correct results always were and continue to be reflected on the tabulator totals tape . . . ." was false.

9. These errors occurred after The Antrim County Clerk provided a re-provisioned CF card with uploaded software for the Central Lake Precinct on November 6, 2020.This means the statement by Secretary Benson was false. The Dominion Voting System produced systemic errors and high error rates both prior to the update and after the update; meaning the update (or lack of update) is not the cause of errors.

10. In Central Lake Township there were 1,222 ballots reversed out of 1,491 total ballots cast, resulting in an 81.96% rejection rate. All reversed ballots are sent to adjudication for a decision by election personnel.

This demonstrated a significant and fatal error in security and election integrity because it provides no meaningful observation of the adjudication processor audit trail of which administrator actually adjudicated the ballots.

12. A staggering number of votes required adjudication. This was a 2020 issue not seen in previous election cycles still stored on the server. This is caused by intentional errors in the system. The intentional errors lead to bulk adjudication of ballots with no oversight, no transparency or audit trail. Our examination of the server logs indicates that this high error rate was incongruent with patterns from previous years. The statement attributing these issues to human error is not consistent with the forensic evaluation, which points more correctly to systemic machine and/or software errors. The systemic errors are intentionally designed to create errors in order to push a high volume of ballots to bulk adjudication.

13.The linked video demonstrates how to cheat at adjudication: https://mobile.twitter.com/KanekoaTheGreat/status/1336888454538428418

14. Antrim County failed to properly update its system. A purposeful lack of providing basic computer security updates in the system software and hardware demonstrates incompetence, gross negligence, bad faith, and/or willful non-compliance in providing the fundamental system security required by federal and state law. There is no way this election management system could have passed tests or have been legally certified to conduct the 2020 elections in Michigan under the current laws. According to the National Conference of State Legislatures Michigan requires full compliance with federal standards as determined by a federally accredited voting system laboratory.

15. Significantly, the computer system shows vote adjudication logs for prior years; but all adjudication log entries for the 2020 election cycle are missing. The adjudication process is the simplest way to manually manipulate votes. The lack of records prevents any form of audit accountability, and their conspicuous absence is extremely suspicious since the files exist for previous years using the same software. Removal of these files violates state law and prevents a meaningful audit, even if the Secretary wanted to conduct an audit. We must conclude that the 2020 election cycle records have been manually removed.

 16. Likewise, all server security logs prior to 11:03 pm on November 4, 2020 are missing. This means that all security logs for the day after the election, on election day, and prior to election day are gone. Security logs are very important to an audit trail, forensics, and for detecting advanced persistent threats and outside attacks, especially on systems with outdated system files. These logs would contain domain controls, authentication failures, error codes, times users logged on and off, network connections to file servers between file accesses, internet connections, times, and data transfers. Other server logs before November 4, 2020 are present; therefore, there is no reasonable explanation for the security logs to be missing.

17.On November 21, 2020, an unauthorizeduser unsuccessfully attempted to zero out election results. This demonstrates additional tampering with data.

18. The Election Event Designer Log shows that Dominion Image Cast Precinct Cards were programmed with new ballot programming on 10/23/2020 and then again after the election on 11/05/2020. These system changes affect how ballots are read and tabulated, and our examination demonstrated a significant change in voter results using the two different programs. In accordance with the Help America Vote Act, this violates the 90-day Safe Harbor Period which prohibits changes to election systems, registries, hardware/software updates without undergoing re-certification.According to the National Conference of State Legislatures Michigan requires full compliance with federal standards as determined by a federally accredited voting system laboratory.

19. The only reason to change software after the election would be to obfuscate evidence of fraud and/or to correct program errors that would de-certify the election. Our findings show that the Central Lake Township tabulator tape totals were significantly altered by utilizing two different program versions (10/23/2020 and 11/05/2020), both of which were software changes during an election which violates election law, and not just human error associated with the Dominion Election Management System. This is clear evidence of software generated movement of votes. The claims made on the Office of the Secretary of State website are false.

20. The Dominion Image Cast Precinct (ICP) machines have the ability to be connected to the internet (see Image 11). By connecting a network scanner to the ethernet port on the ICP machine and creating Packet Capture logs from the machines we examined show the ability to connect to the network, Application Programming Interface (API) (a data exchange between two different systems) calls and web (http) connections to the Election Management System server. Best practice is to disable the network interface card to avoid connection to the internet. This demonstrated a significant and fatal error in security and election integrity. Because certain files have been deleted, we have not yet found origin or destination; but our research continues.

21. Because the intentional high error rate generates large numbers of ballots to be adjudicated by election personnel, we must deduce that bulk adjudication occurred. However, because files and adjudication logs are missing, we have not yet determined where the bulk adjudication occurred or who was responsible for it. Our research continues.

22. Research is on going. However, based on the preliminary results, we conclude that the errors are so significant that they call into question the integrity and legitimacy of the results in the Antrim County 2020 election to the point that the results are not certifiable. Because the same machines and software are used in 48 other counties in Michigan, this casts doubt on the integrity of the entire election in the state of Michigan.

23. DNI Responsibilities: President Obama signed Executive Order on National Critical Infrastructure on 6 January 2017, stating in Section 1. Cybersecurity of Federal Networks, "The Executive Branch operates its information technology (IT) on behalf of the American people. The President will hold heads of executive departments and agencies (agency heads) accountable for managing cybersecurity risk to their enterprises. In addition, because risk management decisions made by agency heads can affect the risk to the executive branch as a whole, and to national security, it is also the policy of the United States to manage cybersecurity risk as an executive branch enterprise. "President Obama's EO further stated, effective immediately, each agency head shall use The Framework for Improving Critical Infrastructure Cybersecurity (the Framework) developed by the National Institute of Standards and Technology." Support to Critical Infrastructure at Greatest Risk. The Secretary of Homeland Security, in coordination with the Secretary of Defense, the Attorney General, the Director of National Intelligence, the Director of the Federal Bureau of Investigation, the heads of appropriate sector-specific agencies, as defined in Presidential Policy Directive 21 of February 12, 2013 (Critical Infrastructure Security and Resilience) (sector-specific agencies), and all other appropriate agency heads, as identified by the Secretary of Homeland Security, shall: (i)identify authorities and capabilities that agencies could employ to support the cybersecurity efforts of critical infrastructure entities identified pursuant to section 9 of Executive Order 13636 of February 12, 2013 (Improving Critical Infrastructure Cybersecurity), to be at greatest risk of attacks that could reasonably result in catastrophic regional or national effects on public health or safety, economic security, or national security (section 9 entities);

This is a national security imperative. In July 2018, President Trump strengthened President Obama’s Executive Order to include requirements to ensure US election systems, processes, and its people were not manipulated by foreign meddling, either through electronic or systemic manipulation, social media, or physical changes made in hardware, software, or supporting systems. The 2018 Executive Order. Accordingly, I hereby order:

Section 1. (a) Not later than 45 days after the conclusion of a United States election, the Director of National Intelligence, in consultation with the heads of any other appropriate executive departments and agencies (agencies), shall conduct an assessment of any information indicating that a foreign government, or any person acting as an agent of or on behalf of a foreign government, has acted with the intent or purpose of interfering in that election. The assessment shall identify, to the maximum extent ascertainable, the nature of any foreign interference and any methods employed to execute it, the persons involved, and the foreign government or governments that authorized, directed, sponsored, or supported it. The Director of National Intelligence shall deliver this assessment and appropriate supporting information to the President, the Secretary of State, the Secretary of the Treasury, the Secretary of Defense, the Attorney General, and the Secretary of Homeland Security.

We recommend that an independent group should be empaneled to determine the extent of the adjudication errors throughout the State of Michigan. This is a national security issue.

24. Michigan resident Gustavo Delfino, a former professor of mathematics in Venezuela and alumni of University of Michigan, offered a compelling affidavit [Exhibit 2] recognizing the inherent vulnerabilities in the SmartMatic electronic voting machines (software which was since incorporated into Dominion Voting Systems) during the 2004 national referendum in Venezuela (see attached declaration). After 4 years of research and 3 years of undergoing intensive peer review, Professor Delfino’s paper was published in the highly respected "Statistical Science" journal, November 2011 issue (Volume 26, Number 4) with title "Analysis of the 2004 Venezuela Referendum: The Official Results Versus the Petition Signatures."The intensive study used multiple mathematical approaches to ascertain the voting results found in the 2004 Venezuelan referendum. Delfino and his research partners discovered not only the algorithm used to manipulate the results, but also the precise location in the election processing sequence where vulnerability in machine processing would provide such an opportunity. According to Prof Delfino, the magnitude of the difference between the official and the true result in Venezuela estimated at 1,370,000 votes. Our investigation into the error rates and results of the Antrim County voting tally reflect the same tactics, which have also been reported in other Michigan counties as well. This demonstrates a national security issue.
