"We had a driver go there around 2 o'clock this morning to get gas, while getting gas there was an individual in the parking lot loitering there,” said Major Brian Johns, Dayton Police Investigations.
Since it was raining, the driver getting gas decided to let that person sit in their car for a few minutes to get dry.
“At one time the individual asked for a ride but didn't have any gas money at that time a disagreement broke out inside the vehicle,” said Major Johns.
That’s when things turned violent.
"I just shot somebody, they tried to rob me,” said the 911 caller.
“The driver of the vehicle pulled out a firearm and shot the person who was loitering causing his death,” said Major Johns.
This is the seventh shooting that Dayton Police have responded to since November 7.
Major Johns says he understands being nice like this driver tried to be, but you also have to be aware of your surroundings.
