WI: No criminal charges coming in fatal garage shooting: "An Okauchee man will not face criminal charges for fatally shooting an unarmed man who broke into his garage in August, Waukesha County District Attorney Brad Schimel announced Friday. James P. Babe IV, 39, was killed outside Michael Fitzsimmons' home about 2 a.m. Aug. 27. Schimel determined that Fitzsimmons, 47, fired two shots in self-defense. Fitzsimmons said he awoke when he heard noise in his garage, that he approached it from his deck and yelled out asking who was there and stated that he had a gun. He said Babe yelled back that he had a gun, then emerged from the garage onto the deck and lunged at him with what Fitzsimmons believed was a gun. Fitzsimmons fired once, and when Babe did not immediately go down or back away, fired a second shot. There was evidence someone had broken into the garage, and Babe's cell phone case and keys were found there."


AL: Shooting is apparent self-defense "Red Bay Police Chief Jana Jackson says that a Thursday night shooting death will be turned over to a grand jury, and at this time, no charges have been filed. The incident began around 5:30 p.m. when witnesses say 42 year old David Andrasik stopped his car in front of a house near the intersection of 10th Street and Hester Avenue. The witnesses report Andrasik got into a verbal altercation with a homeowner that soon turned physical. Andrasik was shot once with a small caliber handgun, rushed to a nearby hospital and was pronounced dead. At this time, Chief Jackson tell us her officers believe the incident was a case of self defense. However, she stresses that the investigation is not finished and the case will be presented to a grand jury."
