Followup CO: Defensive Shooting of Fredrick Price Ruled Justified in Mesa County

In a letter sent to the Mesa County Sheriff’s Office on Sept. 28, 21st Judicial District Chief Deputy District Attorney Bo Zeerip cited Colorado’s “Make My Day” law to explain why no charges were filed in the case.

The statute states that a person is justified in using deadly force against another person when that person has made an unlawful entry into their home and it is reasonable to believe the intruder has committed a crime or intends to physically harm the occupant or their property. The statute shields the home’s occupant from criminal prosecution when deadly force is used against an intruder.

“In this case, the evidence is uncontroverted that Price unlawfully broke into (the shooter’s home),” he ruled.
