The Kansas Supreme Court held that courts are independent of the state's executive branch, when ruling on immunity from prosecution for self defense.
In the case before the court, the self defense claim was very strong. Immunity from prosecution was granted. The state appealed, arguing that the judge was required to look at the evidence in the way most favorable to the prosecutor's case. From cjonline.com:
The state’s highest court rejected a tougher standard set by a lower court for determining when someone can avoid prosecution for wounding or killing another person. The state Court of Appeals had said trial judges must view evidence on self-defense claims in the light most favorable to prosecutors; the Supreme Court said the review must be impartial."Stand Your Ground" and "Castle Doctrine" self defense law reforms are a response to the abuse of prosecutorial power in self defense cases. Defendants may be near certain of winning a jury trial with a claim of self defense. But prosecutors know that undergoing prosecution, with the attendant legal costs, stress, and time consuming defense, is a significant punishment in itself. There is always a small but real chance of conviction. Threatening such proceedings and the highest level of punishment often results in plea bargaining, even if the evidence of self defense is very strong.
The 2006 law says a person who is attacked “has no duty to retreat” and can use force in response. People who are arrested or charged with a crime but assert self-defense can seek a court hearing to determine whether they are immune from prosecution.
Similar to self defense reforms in Florida, the Kansas statute allows a defendant to have a judge review the evidence before prosecution is started. If the evidence is so one sided as to make a conviction very unlikely, the court can grant immunity from prosecution. The point of such immunity hearings is to prevent prosecutors from pursuing cases that are near certain to lose on self defense grounds. The immunity hearing is a mild check on the almost unlimited power of prosecutors.

After weighing the evidence, the district court granted Defendant immunity and dismissed the charges. Djuan Wash, a Wichita community activist, said states can’t ensure that minority defendants will enjoy the same self-defense protections as white defendants. Also, Wash said, a person can provoke an altercation and invoke self-defense when it turns violent.There is no way to ensure that *any* law is absolutely being "applied fairly". The best we can hope for is the principle of equality under the law be understood and celebrated in society; that checks and balances be applied to those in power, from police officers and judges on up; and that a vigorous freedom of speech and the press, as enjoyed on the Internet, allows criticism and exposure of those who abuse their power under the law.
“There’s so little accountability,” he said. “There’s no way to ensure that these laws are being applied fairly.”
With this law, an independent party, the judge, who has no emotional interest in the case, and who has no self interest in piling up a record of convictions, may be appealed to. Only those cases with significantly one-sided evidence are granted immunity.
In the similar Florida law, critics compiled a list of the results of all 119 immunity hearings that had occurred. Black victims were twice as likely to use the law as white victims. John Lott, in the startribune.com:
Florida has the most detailed and by far the most accurate data on Stand Your Ground Laws, compiled by the Tampa Bay Times. Blacks make up 16.7 percent of Florida’s population, but they account for 34 percent of defendants who invoke this defense. Black defendants who invoke this statute are acquitted 4 percentage points more frequently than whites who do so.The Kansas Supreme Court deserves credit for upholding the separation of powers in the Republic. The courts should not simply be an extension of the prosecutor's office.
Kansas is known as the place where the "collective right" fiction about the Second Amendment was created in 1905, by another Kansas Supreme Court. In 2017, the current Kansas Supreme Court made partial amends.

As I have stated before the judge is required to be impartial, no opinion or bias he is a referee in a legal proceeding and required to defend the rights of the accused in a legal proceeding. the state is required to prove you guilty beyond a reasonable doubt. the state is required to enforce the law and prove the evidence not to create criminals. Prosecutors that express a bias or an opinion should not be allowed to prosecute the case. this is all about a fair and unbiased trial. A miss trail is usually based on improper prosecutorial actions the judge may have failed to block. A jury has the power to find a law misapplied or unconstitutional and find you not guilty even if you committed the crime. I have witnessed cops commit criminal assault to obtain evidence. the case was thrown out because the cops violated the law. the evidence could not be used.
ReplyDeleteThe burden of proof of guilt is on the state it is not on you to prove your innocence. Except in the instance when the state has manufactured false evidence or is misinterpreting the evidence it is using. If you prove the state is trying to falsely convict you, you can do some serious damage to careers and make some good money off of the corruption in the system. there are more criminals in government than on the street in the public. these activist judges are just one example. the term activist judge is a term created to keep from exposing the truth of their criminal misconduct on the bench. When a government employee is impeached and removed from office the effect of that conviction is equal to a felony conviction for a civilian. they can never hold another job that requires an oath of office not even a civilian job like a member of the board or CEO of a company. they can never be paid a penny of government funds for any kind of work. they are disqualified from holding any professional license. In many cases that license is a license to practice law and they are permanently disbarred. Honor and integrity is something you either have or do not have. many in government could not even buy it they would not know what to look for. An oath of office is not to a flag or a constitution or any person, it is in fact intended to be a promise to God himself. taking an oath of any kind for anything is a very serious issue. this gets into a very deep religious discussion, the supreme court has ruled we are a Christian nation by the evidence of our founding documents. Prudish adherence to Christian principle and doctrine are the only way to make our government work the way it was designed.
ReplyDeleteNo evidence no crime this brings up the Trump claim of wire tapping, they did not have to tap the white house phones all they had to do is tap any ones phone that the white house may call. Taps recover both sides of a conversation, some times there is no evidence of a crime that is referred to as a perfect crime. that is usually when eye witnesses start disappearing. eliminate the possible leaks. Obama's legacy is disgraceful He needs to shut up and disappear as he further destroys his terrible memory. the entire country has rejected his failures. I am very pleased with what Trump is doing. People wanted smaller government and he is doing it. all the left can do is complain about all of their crony relatives being out of work. Obama thought his well placed land mines were secure. Trump is digging them out and disarming them. there is no reason to replace duds with duds or eliminate do nothing political appointment jobs.
