Tennesse Court finds two Laws Unconstitutional under Second Amendment

Tennessee Capitol

On August 22, 2025, a three judge panel of Gibson County Chancery Court in Tennessee struck down two Tennessee statutes as unconstitutional under both the Second Amendment and the Tennessee state Constitution. The two statutes were Tenn. Code Ann. § 39-17-1307

(a)

(1) A person commits an offense who carries, with the intent to go armed, a firearm or a club.

and

Tenn. Code Ann. § 39-17-1311

(a)
It is an offense for any person to possess or carry, whether openly or concealed, with the intent to go armed, any weapon prohibited by § 39-17-1302(a), not used solely for instructional, display or sanctioned ceremonial purposes, in or on the grounds of any public park, playground, civic center or other building facility, area or property owned, used or operated by any municipal, county or state government, or instrumentality thereof, for recreational purposes.

The three judge panel summed up the issues put forward by the plaintiffs thus.  From the order of the court:

In order to avoid risks of being stopped, detained, issued a citation, and/or arrested, the Individual Plaintiffs must either 1) not take any longarms to the areas enumerated in Tenn. Code Ann. § 39-17-1311(a); 2) not take a handgun to the areas enumerated in Tenn. Code Ann. § 39-17-1311(a); or 3) if he does take a handgun, to make sure he has his permit and that this handgun is generally not visible to third parties in order to minimize the risk of observation or detection by third parties.3

Tennessee requires a three judge panel for cases challenging the constitutionality of a state statute in Chancery Courts. The three judge panel first tackled the general statute forbidding the carry of a firearm or club with the intent to go armed. From the order of the court:

Accordingly, this Court holds that the Going Armed Statute violates the Second Amendment to the United States Constitution and therefore also violates Article I, Section 26 of the Tennessee Constitution. With respect to the Going Armed Statute, Plaintiffs’ Motion for Summary Judgment is hereby GRANTED, and Defendants’ Motion for Summary Judgment is hereby DENIED.

Then the panel considered the ban on carrying or possessing weapons in parks, playgrounds, civic centers, and any property owned by municipal, county or state government. The found the "Parks Statute" to violate the Tennessee Constitution and the Second Amendment of the United States Constitution as well. From the order of the court:

Accordingly, we conclude the Parks Statute violates the Second Amendment to the United States Constitution and therefore also violates Article I, Section 26 of the Tennessee Constitution. Plaintiffs’ Motion for Summary Judgment is hereby GRANTED with respect to the Parks Statute, and Defendants’ Motion for Summary Judgment is consequently DENIED.

Tennessee House of Representatives member Chris Todd has asked AG Skrmett to appeal the decision, in order to obtain a stronger precedent. From X.com:

 Appeal for a Stronger Precedent

I’m respectfully urging @AGTennessee Skrmetti to appeal the recent Chancery Court ruling striking down portions of Tennessee’s firearm laws. Some may assume that asking for an appeal means opposing the ruling — but in this case, it’s the opposite. The Chancellors’ opinion was one of the most thorough, well-reasoned, and well-written decisions we’ve seen. The judges did an outstanding job laying out the constitutional issues with clarity and precision.

That is exactly why I believe an appellate court will affirm this decision, and by doing so, make it even stronger as binding precedent. Such an outcome would provide greater protection for Tennesseans and serve as a reference for similar cases across the country.

AG Skrmetti has 30 days to appeal the decision from the three judge panel.

One of the more interesting precedents in this case it the application to longarms. As longarms cannot generally be carried concealed, a ban on open carry is a ban on the carry of long arms. The Second Amendment does not differentiate between longarms and other types of arms.

Remington low decible .410 "garden gun" loads

A couple of Shot Shows ago, this correspondent suggested to ammunition manufacturers a low powered, small shot cartridge could fill a "garden gun" nitche for Americans.

The idea of a garden gun is a gun firing a low velocity, low powered shot load which is not very loud, but can efficiently dispatch small pests out to about 20 yards. People at Remington must have been thinking along the same lines. They have introduced a "Low Decibel" .410 load which is very close to old garden gun loads.  Many people already have .410 shotguns. They do not need to purchase a dedicated "garden gun" to have garden gun performance. .22 shotshells work pretty well, but have very limited range out of rifled barrels. With a smoothbore gun, such as a Henry Garden Gun, the range can be stretched to about 12 -15 yards. The .410 low decibel load, starting at 650 fps with number nine shot, should be good to 20 yards. The number nine pellet, at that range, will be traveling a tad more than 400 fps. By 40 yards it has dropped to under 300 fps, about the same velocity of a BB gun, but with a much lighter pellet. It should bounce off of most clothes.

It is a real cartridge. At ranges of a few feet, it can be deadly. Shooters have to use good judgement and caution, and understand backstops and ranges. At 25 yards, a half inch pine board should be an effective back stop for #9 pellets traveling under 400 fps.

Sound of the shot will be minimized out of a long barrel. Many .410 shot guns have 28" barrels, which should work well. There is no sonic crack with these loads.

Handloaders can duplicate these results with low powder charges.  It is important to have a good crimp to provide enough resistance for a complete powder burn. Low powered loads will not operate most semi-automatic actions. It is difficult to obtain consistent ignition below 600 fps. The Remington factory ammunition solves the problem of load development if only a few shots are needed.

Ammoseek lists the low decibel shells at about $20 a box of 25. .22 Shot shells on Ammoseek list from about $15 for 50 rounds to $6 for 20 rounds.  Handloading is not a practical option for .22 shot shells.

This correspondent's brother claims 12 gauge loads at about 600 fps have been very effective on pests up to rabbit sized, and are much quieter than a regular cartridge, albeit out of a 36 inch barrel. As American households become more suburban, and "horse properties" of 2 acres on up expand into rural America, the market for garden guns to control pests expands as well. Even if your neighbor is more than a 1/4 mile away, quiet loads prevent disturbing the neighbors when a pest shows up just after a summer sunrise.

Before 1930, backyard gunfire was common in the United States. After WWII, ordinances outlawing gunfire inside city limits proliferated. It all depends on local ordinances, so research in specific locations is called for. Some backward municipalities even ban the shooting of air guns and bows and arrows in the back yard!

Texas prevents municipal ordinances banning the firing of shotguns if you have 10 acres of property, and the shot does not pass the property boundaries. If you are on unincorporated land, counties can regulate shooting on parcels of less than 10 acres. They are not required to do so. Florida allows backyard shooting if the shooter acts prudently.  Shooting on properties of more than 1 acre has fewer restrictions. A low powered garden gun with small shot and a backstop would probably meet the requirements of the law.

Garden guns reached their peak interest between the World Wars. They were popular in Europe between 1900 and 1935.  Because of their low power, they were generally unregulated. More recently, hoplophobia has generated severe ordinances to regulate even the low powered, inoffensive garden gun.

Non-Resident CCW Permits for California

On July 1, 2025, United States District Court Judge Cathy Ann Bencivengo granted summary judgement to Firearms Policy Coallition members to obtain California Concealed Carry Permits. Judge Bencivengo ordered the Plaintiffs and Defendant to submit proposed orders within 30 days. From the order:

For the above reasons, the Court grants Plaintiffs’ motion for summary judgment as to their facial challenge pursuant to the Second/Fourteenth Amendment and denies the request for relief pursuant to the Privileges and Immunities Clause. The parties are ORDERED to meet and confer and submit a proposed order for an injunction consistent with this order within 30 days.

It is SO ORDERED.

The California Attorney General submitted a proposal whereby applicants would have to attest, under oath, they intended to spend time in a California jurisdiction within the next 12 months. It includes four pages of explicit instructions about how non-residents can apply, and what laws they must observe.

The plaintiffs submitted an order which simply says California licensing authorities are permanently enjoined from enforcing Penal Code sections 26150(a)(3) and 26155(a)(3). Judge Bencivengo chose the Firearms Policy Coallition's order. Here it is:

Defendant Attorney General Rob Bonta; Defendant’s officers, agents, servants, employees, and attorneys; and any other persons who are in active concert or participation with Defendant, are hereby permanently enjoined from enforcing California Penal Code sections 26150(a)(3) and 26155(a)(3) as to CCW applications submitted by Plaintiff Firearms Policy Coalition’s members who are not residents of California, including the named Individual Plaintiffs.

The order took effect on August 21, 2025.

California vests the issuing of concealed carry permits with sheriffs and police chiefs. The issuance of permits varies enormously between jurisdictions. 30 years ago, Sheriffs and police chiefs could issue permits to anyone they chose. This became a way for people who desired a permit to escape the horribly restrictive polices of sheriffs or police chiefs in large cities. Some counties were issuing thousands of permits to people who did not reside in their jurisdiction.  The California legislature passed a statute forbidding the issuance of permits to people who did not live in the jurisdiction of the issuing authority.

The permanent injunction applies only to non-residents of California who are members of the Firearms Policy Coalition. This effectively makes it easier for non-residents of California to obtain California concealed carry permits than for residents of some restrictive areas in California. For example, only 100 to 200 permits were expected to be issued for San Francisco in 2024.

The order does not limit what jurisdiction an applicant may apply in. Placer County California already lists a process for obtaining a non-resident concealed carry permit. It is not clear how non-resident applicants may qualify with their personal handguns.

In the next few months, there will be many applications for non-resident concealed carry permits in California. The process may vary significantly by county.

Those counties which cater to non-residents are likely to reap the rewards of their efforts. California concealed carry permits are currently valid for two years. At the Crime Prevention Research Center, the cost of obtaining a California permit was summed up at over a thousand dollars for the initial permit, and over $600 for renewal, in 2023.  Some jurisdictions, such as Placer County, appear to charge a couple of hundred dollars less.
