CA: Pleasanton - Gunfight in Pleasanton home, handgun - v Shotgun, Victim shot six times

According to police, witnesses said the incident started when Kaplan went to the victim’s home located in the 3600 block of Vineyard Avenue at around 3 p.m. Saturday to confront the older man about alleged animal abuse. The Alameda County Inmate Locator lists Kaplan’s current occupation as dog trainer.

Per witness statements, at some point the victim retrieved a shotgun, but it is still unclear what escalated the initial confrontation and led Kaplan to shoot the 71-year-old at least six times, according to police. Stocking said it appears that the victim did not fire his weapon.

MI: Three Judge Panel in Sixth Circuit: Right to Keep Arms applies to Possession of Arms

In the case of Novak, et al. v Federspiel, Saginaw County Sheriff's Office seized fourteen guns from a cabin where a domestic violence event occurred. The cabin's owners waited until the domestic violence case was completed. Then the owners of the cabin, who are relatives of the person charged, asserted the guns belonged to them and asked the Sheriff to return them. The guns were first taken in 2017.

The Sheriff refused to do so, saying, in part, the owners had not provided proof they owned the guns. Some of the guns were manufactured pre-1968 and were not made with serial numbers. The guns were older, and the owners did not have copies of receipts. Novak and Wenzel have filed affidavits stating they own the firearms.

Novak and Wenzel filed several state and federal cases against Sheriff Federspiel in his official and personal capacity, including claiming violation of their Constitutional rights under the  Fourth, Fifth, Fourteenth, and Second Amendment rights, in various permutations. Eventually, the lawsuits were dismissed at the state and federal level and the plaintiffs filed an appeal to the three judge panel of the Court of Appeal for the Sixth Circuit.

The three judge panel heard the case and reversed the District Court on summary judgement for a Fifth Amendment takings claim against Sheriff Federspiel, to allow a trial court to sort out those claims.

The three judge panel upheld the dismissal of due process claims.

The three judge panel examined the Second Amendment claims. They vacated the District Court's summary judgement against the plaintiffs and sent the case back to the District Court. From the opinion bold added:

The right to keep or bear firearms would mean little if an individual lacked any presumptive right to keep or bear his own firearms. See Frein v. Penn. State Police, 47 F.4th 247, 254 (3d Cir. 2022). In that event, one might ask, whose firearms would one keep or bear? The district court, for its part, said the Second Amendment did not apply here because Federspiel had not interfered with Novak’s or Wenzel’s ability to buy or own other guns. But that reasoning has neither any limiting principle nor any basis in the caselaw; to the contrary, it conflates Bruen’s two steps into one.

The right to keep or bear one’s own firearms is quintessentially conduct that falls within the text of the Second Amendment. The relevant questions here, rather, are twofold. First whether these plaintiffs in fact owned these guns. And second, if so, whether Federspiel’s possession of them has been “consistent with the Nation’s historical tradition of firearm regulation.” Bruen, 597 U.S. at 24. The district court can address those questions as necessary on remand.

We vacate the district court’s grant of summary judgment to Federspiel on the official-capacity Second Amendment claims.3

This is an important precedential case. While this case includes disputes about proof of ownership, confiscation of arms found during a criminal investigation is common. Around the country, this correspondent often sees officials promiscuously confiscating arms which have nothing to do with the crime which was committed. To treat firearms as contraband is to treat the Second Amendment as a second class right.

Romanian Brown (Grizzly) Bear Population, Attacks and Hunting

Romania in green image public domain

Romania has the highest brown (grizzly) bear population in the European Union, and the highest number of fatal bear attacks. Russia has many more bears, including more in the European part of Russia, but most Russian bears are in Asia.

A study using DNA, started in 2022 and finished in 2025, is the most accurate measurement of Romanian brown bears to date. The study shows a brown bear population of between 10,419 - 12,770 brown bears in Romania. This is about twice the previous thought number.

In 2021, estimates of the brown (grizzly) bear population ranged from 2,000 to 10,000. From rferl.org in 2021:

The official number of brown bears in Romania is over 6,000. But the government is not actually sure of the number, and environmental groups argue that it might be as low as 2,000. Hunting associations say the number could be as high as 10,000.

The study was conducted, in part, because of the increasing number of brown bear attacks. From phys.org/news/2025:

The new study—launched in 2021, with the EU contributing 11 million euros ($12 million) in financing—concluded between 10,419 and 12,770 brown bears live in Romania, while authorities say the optimal number is 4,000.

"We can state for the first time in the history of Romania with a solid scientific basis how many bears we have in the forest," environment minister Mircea Fechet told a press conference.

(snip)

Over the past two decades, bears have killed 26 people in Romania and seriously hurt 274, according to 2024 data.

The actual number was over 10,000. 11,000 is a reasonable estimate. If we assume 1,500 bears to start, and a growth rate of 10.5%,  the number of fatal attacks per 1000 bears per year is .26. There are more than 10 serious brown bear maulings with severe injuries in Romania for every fatal attack recorded in Romania.

If we assume a population growth of 7% per year, with a starting population of 3,000 bears 20 years ago, we reach a current population of 11,600 bears in 2024. There were 26 fatal attacks over the 20 years or about .20 fatal attacks per 1000 brown (grizzly) bears per year.

The differences are not great. We do not know the initial number with precision.

Romania banned trophy hunting of bears in 2016, but has allowed limited hunting. About 1400 bears were harvested from 2016 through 2020, or about 280 bears per year. This is about 3.5% of the population per year for the period. If the population was increasing at 10.5% per year, 3.5% harvested would leave a 7% increase in the population. In 2023, Romania increased the bear harvest quota to 484 bears. Assuming a population of 10,000 bears, it is only a 4.84% harvest. To reach stability at 11,600 bears, about 1,100 to 1,300 bears need to be harvested each year.

Most of the bear hunting in Romania appears to be over bait, from well maintained permanent blinds. Much of this bait hunting may be at night. In Sweden the bear harvest is about 9% or more as they work to reduce the brown (grizzly) bear population to the desired level. Most bear hunting in Sweden is done with a trained dog. Sweden has had only 2 fatal bear attacks from 1977 to 2016. This calculates to about .011 fatal bear attacks per 1000 bears per year in Sweden. Sweden has had continual legal hunting of brown (grizzly) bears since 1943.  Romanian brown bears are about 20 times as likely to be involved in a fatal attack than are Swedish brown bears.

Does hunting with dogs teach brown (grizzly) bears to be wary of people, so they avoid humans? It seems likely.

Fifth Circuit Holds Gun Free School Zone law to be Constitutional

Image from 12newsnow.com

Unsympathetic defendants make for bad precedents. This is what happened in the Rahimi case, where the Supreme Court opened the door a crack, allowing judges to believe they can create more exceptions to Second Amendment rights.  Rahimi is cited as the reason for the upholding of the Gun Free School Zone Act in the Fifth Circuit.

On January 29, 2023, 25 year old Ahmed Adballa Allam had been living and traveling around the United States in his father's Toyota RAV4 since July of 2022. He had purchased an AR-15 type rifle in Pennsylvania on the way to California.  He had traveled to California and then to Texas, sometime in early January, 2023. Allam insisted on camping out in the RAV4 near St. Anthony Cathedral Basilica School or near Temple Emanuel, a Jewish Synagogue, both in Beaumont Texas.

The principle of the school was concerned about Allam's actions and called police several times per day.  School staff and parents repeatedly contacted Allam and asked him to leave. Members of the Synagogue also asked him to leave several times. Until Allam was arrested, he had been contacted by police upwards of nine times. From 12newsnow.com:

On January 29, 2023, Beaumont Police received multiple calls about a suspicious vehicle around St. Anthony Cathedral Basilica School and Temple Emanuel. The callers said a man in a black Toyota Rav 4 with New York license plates was parked across the street and staying there for hours and even days at a time.

On January 29, Allam started to move the SUV from its parked position, and was immediately stopped for a traffic violation. The officer called for backup. After failing to comply with officers' instructions, Allam was arrested and the SUV was searched as an inventory. Among other things, they found the AR-15, unloaded, in its original cardboard box, a loaded 30 round magazine, and 150 rounds of ammunition. Even a small, weak lock on the cardboard box would have met the requirement for the rifle to be in a "locked case".  From findlaw.com:

On Sunday afternoon, January 29, a school parent confronted Allam, who was sitting in his SUV parked adjacent to the school, and asked him to leave the area. Allam responded that he had a “mission” and that no one would ever see him again after Monday. Alarmed by Allam's ominous statement and based on a strong suspicion that Allam possessed a gun, the parent immediately prompted BPD to post an officer near Allam's SUV. Later that Sunday, when Allam began to drive the SUV from its parked location, the officer stopped him for various alleged traffic violations.2

In the search of Allam's possessions, texts were found about Jihad, killing cats, and the legitimacy of rape and murder during Jihad.

A grand jury returned a single charge of possessing a firearm in a Gun Free School Zone. The case was heard in the federal district court: United States District Court, E.D. Texas. UNITED STATES of America v. Ahmed Adballa ALLAM CASE NO. 1:23-CR-10 Decided June 14, 2023.  The court could not find a historical precedent.

Therefore, the Government has failed to show that the 1,000-foot zone around a school should be included in the Supreme Court's identification of “schools” as sensitive places, or that it is analogous to the sensitive places previously identified by the Supreme Court, such that it should be considered a new sensitive place.

Unable to find a historical precedent for a gun free zone (GFSZ) outside of school property, the court decided to create a new exception where the exercise of Second Amendment rights could be infringed - the "buffer zone". The court reasoned it could do this because "school shootings" were an "unprecedented societal concern".

The court is of the opinion that the prevalence of school shootings—protection from which is one of the aims of § 922(q)(2)(A)’s enactment—in this modern era, is certainly an “unprecedented societal concern.”

Only one law about a firearms "buffer zone" existed during the revolutionary era.  The Delaware state Constitution created a buffer zone around polling places during the Revolutionary war in 1776, during the founding era. It applied to "Battalions or Companies, not individuals. It only applied on election days. It was removed from the Delaware Constitution one year after the Second Amendment was ratified. No further "buffer zone" laws were enacted until well after the Civil war, when a few were enacted from 1870 on. There have been school shootings since the colonial era, just not as frequently as present.

The court makes a strained comparison that the threat to schools continues all the time (even when the school is not open!) therefore a permanent, continual law is acceptable! The court used the Rahimi case as a lever to open this loophole.

III. Conclusion

As detailed above, § 922(q)(2)(A)’s prohibition on the possession of firearms within 1,000 feet of school property is not “an ‘outlier[ ] that our ancestors would never have accepted.’ ” Rahimi, 61 F.4th at 460 (quoting Bruen, 142 S. Ct. at 2133). Therefore, the statute is constitutional, and both Allam's facial and as-applied challenges fail. Accordingly, Allam's Motion to Dismiss the Indictment (#22) is DENIED.

The three judge panel for the Court of Appeals for the Fifth Circuit goes even further afield. It relies on the 14th century Statute of Northhampton, which had nothing to do with schools, and which had become dormant before the English Bill of Rights was written. It appears the Fifth Circuit panel was heavily influenced by an unsympathetic defendant. If a law can be used against an unsympathetic defendant, it can be used against you. From Courtlistener.com:

By contrast, Allam focuses heavily on the lack of a conclusive historical analogue to § 922(q)(2)(A)’s 1,000-foot buffer zone. But this focus misses the mark. We need not—and do not—fix how far a buffer zone may stretch before it runs afoul of the Second Amendment to decide Allam’s as-applied claim. Section 922(q)(2)(A)’s buffer zone needed to do very little work here, if any. Allam had camped out only 40 feet from school grounds. His SUV was parked on a street bordering campus—adjacent to school zone lighting and signage—at a location where students crossed routinely to get to the off-campus basilica. He was also behaving erratically and menacingly, so much so that people repeatedly called the police, and St. Anthony changed its students’ routines and traffic patterns. As applied here, § 922(q)(2)(A) is “relevantly similar” to the Statute of Northampton and going-armed laws and the (limited) historical examples of firearm restrictions in educational settings and buffer zones around polling places, which corroborate the constitutionality of disarming a visibly threatening individual as near a school as Allam was.17

With all the "menacing" the local police should have found a more local solution than the GFSZA. This is an "as applied" case instead of a facial challenge. "As applied" cases are not supposed to be as precedential as facial challenges. In reality, the difference between "as applied" and facial challenges is eroding.

This is a poor decision. Challenges to the Gun Free School Zone Act are not easy to come by, because federal prosecutors have been wary of challenges which would show how bad the law is. In the Ninth Circuit, a much more sympathetic defendant has appealed a conviction under the GFSZ. We should know if the three judge panel in the Ninth Circuit will be willing to accept the Second Amendment challenge, in a few months. The Ninth Circuit has been hostile to Second Amendment cases.

Those grandsons ran to get their father to intervene, who is the son of Fairbanks.

That son says he discovered Fairbanks on top of and attacking his mother, and attempted to stop Fairbanks’ attack.

However, the son says Fairbanks then attempted to attack him with a long sliver object, and after firing a warning shot, ultimately shot his father multiple times, killing him.

That son is not currently facing any charges, and Johnson says it seems like the second incident is defense while the first incident will require further investigation.

On the way to Augusta Health, the vehicle transporting May in the 2500 block of Springhill Road met deputies, and Staunton Augusta Rescue Squad personnel arrived to assist with life-saving measures. Those efforts were unsuccessful, the release said, and May was pronounced deceased at the scene.

While at the Springhill Road location, the driver who had been transporting May told deputies he shot the person who stabbed May. Deputies responded to the original location on Old Quarry Road, where they found a man dead from an apparent single gunshot wound to the head.

NICS Checks for June, 2025 Gun Sales 5% lower then 2024

In June of 2025, gun sales dropped 5% from June of 2024, according to the adjusted National Instant background Check System (NICS) as calculated by the National Shooting Sports Foundation, (NSSF). The number of adjusted gun sales totaled 1.06 million. This is the 71st month where the adjusted NICS numbers were over a million. The adjusted NICS numbers are calculated by the NSSF by taking the total number of NICS checks for the month, as supplied by the FBI, then subtracting the number of NICS checks for firearm permits and firearm permit rechecks.  May, June and July tend to be the lowest numbers for NICS checks of all the months. As June numbers are only 60 thousand above 1 million, it is uncertain if the number of sales for July of 2025 will be over a million. We will know in about a month.

Over the last 12 months, only three months have had greater numbers of firearm sales than the month from the previous year, although the overall drop in the other nine months is not large. The number of people with confidence in the Trump administration to look after the best interests of the United States is much improved compared to the Biden administration. The number of total NICS checks diminished by 2.5% from June of 2024, half as much as the adjusted number of firearm sales.

The firearms sales numbers are an estimate, because one NICS check can be used to purchase more than one firearm, and about 1 million people have permits which can be used as a substitute for a NICS check, as obtaining the permit already required a NICS check.

The economic numbers for the United States are strong. President Trump's policies appear to have worked in diminishing the nuclear threat from Iran, coordinated with Israel. The Russia/Ukraine war continues, as President Trump attempts to bring about a ceasefire. The unsustainable spending and debt are at least acknowledged. There is a plan to deal with them. The Congress is so addicted to spending that a greater Republican majority will be needed to make the large cuts required. The Big Beautiful Bill has passed. It will take some time to determine all of the effects. It appears the tax on National Firearms Act (NFA) silencers/suppressors, short barreled rifles, short barreled shotguns, and any other firearms will be reduced to zero dollars. The tax on machine guns and destructive devises remains at $200. There will likely be lawsuits filed attacking the viability of a tax law regulating constitutionally protected items for zero tax income. The bill contains this language, as sent to President Trump:

SEC. 70436. REDUCTION OF TRANSFER AND MANUFACTURING TAXES FOR CERTAIN DEVICES. (a) Transfer Tax.--Section 5811(a) is amended to read as follows: ``(a) Rate.--There shall be levied, collected, and paid on firearms transferred a tax at the rate of-- ``(1) $200 for each firearm transferred in the case of a machinegun or a destructive device, and ``(2) $0 for any firearm transferred which is not described in paragraph (1).''. (b) Making Tax.--Section 5821(a) is amended to read as follows: ``(a) Rate.--There shall be levied, collected, and paid upon the making of a firearm a tax at the rate of-- ``(1) $200 for each firearm made in the case of a machinegun or a destructive device, and ``(2) $0 for any firearm made which is not described in paragraph (1).''.

 The NFA reform shall apply:

to calendar quarters beginning more than 90 days after the date of the enactment of this Act.

If President Trump signs the Big Beautiful Bill on July 4th, 2025, according to this correspondent's reading of the calendar, the changes will go into effect on January 1, 2026. This may have the effect of dampening silencer/suppressor and short barreled rifle and shotgun sales during the next six months, as people wait to take advantage of the NFA reform.

The world appears a bit more stable during the Trump administration. The domestic situation appears more rational. The economy appears to be doing better.

This correspondent expects firearm sales in July, as estimated by the adjusted NICS, to be very close to 1 million firearms.

Federal Court rules California must allow Non-Residents to Apply for Concealed Carry Permits

On July 1, 2025, in the Southern District of California, Federal District Judge, the Hon. Cathy Ann Bencivengo has ruled the State of California must modify their law to allow non-residents to apply for concealed carry permits. The logic is clear. At the time of the founding their was no requirement banning non-residents from carrying weapons for self-defense. Judge Bencivido stated:

The sole issue in this case is whether the Constitution requires California to allow nonresidents to apply for a concealed carry weapons (CCW) license. Plaintiffs, who are not California residents, complain that they are prohibited from carrying a firearm for self-defense when they visit California.

This correspondent believes the issues in this case are much broader, but this correspondent is not the District Judge.

The State of California contended that bans on licenses for carry were common for non-residents. For example, from the Defendants brief:

Nineteenth century law further reflects this historical principle. In 1880, the City of Brooklyn promulgated a law providing that “[a]ny person twenty one years of age and over . . . who has occasion to carry a pistol for his protection, may apply to the officer in command of the station house of the precinct where he resides, and such officer, if satisfied that the applicant is a proper and law abiding person” shall recommend that the Commissioner of Police issue him a permit.

It appears to this correspondent the time frame of the laws in question are much too late to be considered relevant. Judge Bencivido has issued an order granting partial summary judgement in part to the plaintiffs. From the order:

V. CONCLUSION

For the above reasons, the Court grants Plaintiffs’ motion for summary judgment as to their facial challenge pursuant to the Second/Fourteenth Amendment and denies the request for relief pursuant to the Privileges and Immunities Clause. The parties are ORDERED to meet and confer and submit a proposed order for an injunction consistent with this order within 30 days.

In August of 2024, Federal District Judge Garnett ruled California must issue concealed carry permits to non-residents in some cases. Judge Garnett's District Court is in the Central District of California. The cases have considerable similarities. This does not mean they will come to the same conclusions. This case, in the Southern District of California has broader implications, in the opinion of this correspondent. In 30 days we should see the proposed order if both parties are willing to agree to one.  The Trump administration's active protection of rights which the Second Amendment covers is bound to have an effect on the proposed order.

States banning carry by non-residents is coming under increasing scrutiny. In Massachusetts, the State Supreme court dodged the issue.  On May 2 of 2025, Attorney General Bondi sent a letter to Pennsylvannia reminding them of their requirement to issue permits to nonresidents. From the letter:

I write with concern that county sheriffs in Pennsylvania are administering the Commonwealth's Uniform Firearms Act in a manner that denies the right to bear arms to out-of state residents. This practice is unlawful under Pennsylvania law. It also raises serious concerns under the Second Amendment, which guarantees the right to bear arms in public, as well as the Privileges and Immunities Clause, which prohibits discriminating against out-of state citizens by denying them the exercise of fundamental rights.

Analysis: State laws which prevent law abiding people of the United States from exercising the rights protected by the Second Amendment are obviously unconstitutional. The requirement of a permit in order to exercise these right has not yet come before the Supreme Court. It is difficult to see how a fundamental, enumerated right can legitimately be infringed upon by requiring numerous fees, background checks, and waiting periods. It is plausible all of these infringements will eventually be struck down as unconstitutional. The current court cases are incremental steps in that direction.

Campus Carry Coming to South Dakota and Wyoming on July 1, 2025

 uw-madison - https://admissions.wisc.edu/campus-virtual-tour/bascom-hill/

There are 12 states where concealed carry on campus is legal during the first half of 2025. On July 1, 2025, there will be 14 as laws become effective in Wyoming and South Dakota.

On  June 30, 1971, the 26th Amendment was ratified allowing people 18 years and older the right to vote in the United States. Thus the age of majority was lowered from 21 years old to 18 years old.  Most students at universities are less than 21 years old. For most of the history of the United States, universities took on the role of a parent for the minors who were students. Many, if not most, forbid activities they considered dangerous. When the age of majority was lowered to 18 in 1971, the "in loco parentis" authority largely disappeared.  People of age 18 or older had legal control of their lives.

In September, 2006, the Utah Supreme Court ruled that under Utah law, the University could not unilaterally ban the legal carry of concealed weapons on campus. Six months later, in April of 2007,  the Virginia Tech mass murder was perpetrated. 32 students and faculty were murdered. All of the victims were disarmed by University policy. Virginia Tech continues a broad ban on all weapons and some toys today.

The horrendous mass murder at Virginia Tech and the successful implementation of campus carry in Utah helped spur a movement to secure the rights protected by the Second Amendment to state institutions of higher learning across the United States. Several research papers have found no noticeable effect on homicides, suicides or accidents in those states which have passed laws preventing public institutions of higher learning form banning the carry of handguns for defense of self and others.

The states that have removed infringements or ruled them to be illegal occurred in the following order:

Utah 2006, Colorado 2010, Oregon 2011, Wisconsin 2011, Mississippi 2012, Idaho 2014, Tennessee 2016, Arkansas 2017, Georgia 2017, Kansas 2017, Texas 2017, West Virgina 2024, and as of July 1, South Dakota 2025, and Wyoming 2025.

Campus carry to start in South Dakota. From keloland.com:

On July 1, pistols and handguns will be allowed on public college campuses and technical schools in South Dakota.

A senate bill that passed during this year’s legislative session prohibits universities from restricting firearms on school property.

Wyoming will allow persons with permits to carry in Wyoming schools on July 1, 2025.

Campus carry has had a sterling reputation. As of June of 2025, no one who could legally carry a handgun on campus has been found to commit a homicide or a suicide. Many students who do not carry guns have been victims of homicide or have committed suicide. The fears of those opposing campus carry have been shown to be fantastical.  They stem from the mindset that guns are bad. Banning guns on campus appears to be based on emotion rather than fact. Many of the arguments used against concealed carry on campus are "mindset" arguments. How will I feel? Will I feel less safe? Will some people refuse to choose a campus were students can legally carry guns? Very few arguments deal with statistics of how licensed concealed carriers have fewer legal problems than do police officers.  Paradoxically, as academics have moved to the left, state legislatures have embraced the Second Amendment. There are more state universities where it is legal for students to exercise rights protected by the Second Amendment than ever before.

Montana Gun Free School Zone Case: Oral Arguements in Ninth Circuit Appeal

Vivian and Gabriel's modest home in Billings, Montana

In the Ninth Circuit appeals case of USA v. Metcalf, the oral arguments were held on June 12, 2025, in Portland, Oregon. The case centers around the federal prosecution of Gabriel Metcalf possessing a firearm in a Gun Free School Zone outside his home in Billings, Montana. Gabriel had no prior criminal history.

The attorneys arguing the case were the same as in Montana. The Federal defender arguing for Gabriel Metcalf was/is Russel Hart. The Federal prosecutor was/is Thomas Godfrey. The three judge panel in the Court of Appeals for the Ninth Circuit consists of Judge Mary M. Schroeder (Carter appointee) , Judge John B. Owens (Obama appointee), and Judge Lawrence Vandyke (Trump appointee).

The oral arguments lasted 38 minutes. The judges in the case were particularly interested in whether the case of Rehaif v. United States was a precedent which was binding in the Metcalf case. In Rehaif, the Supreme Court ruled the prosecution had to show the defendant knew he was in violation of the law. In the Metcalf case, Gabriel Metcalf had been repeatedly told he was not in violation of the law, and had called the FBI to ask for assistance, believing he was being harassed by local law enforcement.

The prosecution claimed Metcalf had been told he was in violation of federal law. The defense countered with the observation the day Metcalf was arrested, there was an article in the paper where a local police chief said Metcalf had not done anything they could arrest him for, so the police were going to talk to federal officials.

Much of the oral arguments focused on whether Metcalf reasonably knew he was in violation of the federal gun free school zone law, and whether he was required to know he was in violation in order to be found guilty under the law.

The judges were applying the principle that, if the case could be resolved without determining whether the law violated the Constitution, the case should be resolved at the lower level. There was considerable discussion as to whether the Montana law which granted a license to all who were not prohibited from owning weapons met the standard required for an exception in the federal law.

The prosecution claimed Metcalf had serious mental issues. The defense countered with facts about the order of protection violations by Metcalf's neighbor. The defense made clear the neighbor was convicted of a felony violation. Metcalf and his mother complained of continuing violations. Billings police had instructed  Metcalf and his mother about the necessity of gathering video evidence of such order of protection violations.

At the end of oral arguments, the judges ordered the attorneys to submit briefs, of no more than 10 pages, addressing the impact, if any, of the Rahaif case. The briefs are due within 14 days.

Analysis:  The Gun Free School Zone Act was found to be unconstitutional in 1995, in US v. Lopez. Minor changes to the law were made in 1996-1997. The changing of twelve words have been found to be sufficient to make the act constitutional in six circuit courts of appeal, including the Ninth Circuit. Three circuit courts of appeal have found the change to have been insufficient. Those are the First, Third, and Eleventh Circuits. Previous challenges have been under the interstate commerce clause. Two current challenges to the law under the Second Amendment are the Gabriel Metcalf case in the Ninth Circuit and the Ahmed Allam case in the Fifth Circuit.
