This is a problem in many urban areas, and it is spreading all over the country. The policy is to impound guns, in extreme cases, all guns that officers come across, whether involved in any crime or not, then to refuse to return the guns until a judge issues an order to return them. As the attorney fees can easily be 10 times what the gun is worth, most people do not bother. It is a form of legalized theft. Good for Derrick Washington for refusing to countenance this outrageous policy. In his case, state law pre-empts city law, so the case should be very clear.
CLEVELAND, Ohio -- Within days of Derrick Washington's arrest in
February, Cleveland city prosecutors refused to press charges against
him over his possession of a .38-caliber Taurus, citing a lack of
evidence in the case.
Nine months after his arrest, the city continues to hold onto
Washington's gun in a case that has drawn outrage among guns-rights
advocates for how the city handles weapons seized from people who are
never charged with crimes.

Anyway, I once lived in Cleveland and to get you guns, ammo, etc. back, you have to higher and pay a lawyer to go get the stuff back for you.
A friend of mine who worked as NASA had his taken, because maintenance went into his apartment and saw the gun safe and that was, at the time, against the rules of the apartment building.
Lot of BS to go thru but if you want your stuff back, get a lawyer.
In this case with a Taurus .45, the lawyer may cost more that the handgun is worth.
Sorry, I meant Taurus .38 and not .45.
