WA: No Charges for Mark L. Allen in Shooting Death of Roger Swigart

Eye witnesses say they saw both men exit their vehicles after the near collision and began to physically fight with one another.

Allen told authorities that Swigart was choking him. Allen told investigators he heard Swigart say he was going to kill him while he clamped down on Allen's neck.

Allen says he reached for his .40 caliber pistol in his truck and fired a shot over his shoulder, striking Swigart in the head.

According to court documents, Allen left Swigart bleeding on the ground to call the sheriff.
