Police said Peak and another man were physically assaulting David Johnson Gray, a 57-year-old Black man, when a firearm was dropped during the altercation. Investigators said Gray retrieved the firearm and fired several rounds, striking Peak as he and the other man were attempting to run away. The other man was not hit, police said.
