Followup OH: No Charges for Store Owner who Shot, Killed Robber

In December, Deters had announced the case was closed. After Tye’s family attorney Fanon Rucker in January asked the U.S. Department of Justice to open a civil rights investigation, prosecutors re-examined the Aug. 8 and Nov. 14 robberies

Deters said on Tuesday the suspect in the August robbery had a silver semi-automatic handgun and fled in a blue Chevy Blazer. Deters said police later established that Tye owned a blue Blazer and a handgun.

Deters said the robbery suspect threw off a coat as he fled Nov. 14 and that Tye’s DNA was found on the coat.

On Nov. 19, when the store owner shot and killed Tye, Deters said video from a nearby home shows Tye’s blue Blazer drive by the store and park around the corner.
