Upon investigation, it was determined that a gathering had occurred Sunday in the 100 block of South Commonwealth Avenue, and that at some point during the early morning hours the 29-year-old man left the gathering on foot. He subsequently returned to the area and entered the residence on Carr Street, which was near the location of the gathering. The resident of this location, a 79-year-old man, awoke to find the younger man sleeping. At some point a verbal and physical altercation occurred between the two which led to the shooting.
The facts of the case were reviewed by the Kane County State’s Attorney’s Office and it was determined that no charges would be filed in this case.
